Sarbanes-Oxley Act of 2002 has expanded the federal law of obstruction by adding new sections to 18 U.S.C. ยง 1512 where its a crime to destroy evidence even if an investigation is not active. Any thoughts on failing to have a litigation hold policy or implementing a litigation hold and employee to delete potentially useful info in connection with a government investigation? This issue comes up in eDiscovery on a routine basis and was curious if anyone had any thoughts on it since the law does not require a litigation hold policy, but if you do not have one and the feds come knocking, issues may follow.

I’m with Thomson Reuters / Pangea3 unit. We provide eDiscovery services to clients in a wide variety of cases. From the description of the group, I thought that I might be able to offer a few insights into the actual practices involved in providing those eDiscovery services to our clients.

Nevada requires a private investigator license to conduct computer forensic services in Nevada. Does Pangea3, Kroll, or other major out of state players conducting such services remotely on a NV computer still require a P.I. license?
